The Environmental Justice under the Forest Plantation implementation : The case study of Mueang Ling sub-district, Chomphra District, Surin province

Abstract

This thesis aims to (1) study environmental justice under the forestry plantation project based on the case study of Mueang Ling sub-district, Chomphra District, Surin Province and (2) study and propose recommendation for an existence of the environmental justice under forestry plantation implementation in Mueang Ling sub-district, Chomphra District, Surin Province. The data collection was conducted through in-depth interview with 11 key informants, as well through focus group method comprising 20 participants.

The research revealed that environmental justice can be reflected from all stages of forestry plantation in Mueang Ling sub-district, Chomphra District, Surin Province. The forest plantation stages in Mueang Ling comprise: plantation and registration; harvesting and timber movement; timber processing; as well as sale and export. Overall, three types of environmental justice including: the distributive justice; the procedural justice; the justice as recognition; can be reflected from all stages of forest plantation in Mueang Ling. Even though most of environmental justices represented from the Mueang Ling forest plantation are the distributive justice and the procedural justice, the justice as recognition can be implied. The main aspects of the distributive justice discovered from the Mueang Ling forest plantation is granting rights to forest plantation and also rights to forest registration. The main aspects of the procedural justice revealed from the Mueang Ling forest plantation comprise: public access to related information; dissemination of information; and public participation with forest planation project. In contrast, the aspect of justice as recognition only can be implied from the Mueang Ling forest plantation. There is no law or related policy clearly address about an existence of justice as recognition in the forestry plantation in Mueang Ling sub-district, Chomphra District, Surin Province. Only the provision of enabling public participation in forestry plantation in Mueang Ling sub-district, Chomphra District, Surin Province can be reflected as well as there is no law or policy clearly exclude anyone from the forestry plantation in Mueang Ling. Thus, these can be implied that justice as recognition can be implied from the Mueang Ling forestry plantation.

According to the existence of three types of the environmental justice found by this research, the set of recommendations are proposed to enhance the environmental justice for the forest plantation in Mueang Ling sub-district, Chomphra District, Surin Province.

วิทยานิพนธ์นี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความยุติธรรมทางสิ่งแวดล้อม ภายใต้ขั้นตอนการทำสวนป่า ในท้องที่ ตำบลเมืองลีง อำเภอจอมพระ จังหวัดสุรินทร์ (2) ศึกษาและเสนอแนะต่อการส่งเสริมให้เกิดความยุติธรรมทางสิ่งแวดล้อม ภายใต้ขั้นตอนการทำสวนป่า ในท้องที่ ตำบลเมืองลีง อำเภอจอมพระ จังหวัดสุรินทร์ โดยดำเนินการวิจัยจากการเก็บรวบรวมข้อมูลจากการสัมภาษณ์เชิงลึก (in-depth interview) จำนวน 11 คน และเก็บรวบรวมข้อมูลจากการสัมภาษณ์สนทนากลุ่ม (focus group) จำนวน 20 คน

ผลการวิจัยพบว่า ความยุติธรรมทางสิ่งแวดล้อมสามารถสะท้อนได้จากความยุติธรรมทางสิ่งแวดล้อมในทุกขั้นตอนการทำสวนป่า ในพื้นที่ตำบลเมืองลีง อำเภอจอมพระ จังหวัดสุรินทร์ กล่าวคือการทำสวนป่าในตำบลเมืองลีงนั้น ได้ดำเนินการครบทุกขั้นตอนในการทำสวนป่าแล้ว ได้แก่ การปลูกและการขึ้นทะเบียน การตัดโค่นและเคลื่อนย้ายไม้ การแปรรูปไม้ และรวมถึงการขายและการส่งออก ในภาพรวมการทำสวนป่าและในพื้นที่ตำบลเมืองลีง สะท้อนการมีอยู่ของความยุติธรรมทางสิ่งแวดล้อม ทั้ง 3 ลักษณะ คือความยุติธรรมทางสิ่งแวดล้อมเชิงการกระจาย ความยุติธรรมทางสิ่งแวดล้อมเชิงกระบวนการ และความยุติธรรมทางสิ่งแวดล้อมเชิงการยอมรับ ถึงแม้ว่าการสะท้อนการมีอยู่ของความยุติธรรมทางสิ่งแวดล้อมดังกล่าวนี้ ส่วนใหญ่แล้วจะเป็นความยุติธรรมทางสิ่งแวดล้อมเชิงการากระจายและเชิงกะบวนการ ส่วนความยุติธรรมทางสิ่งแวดล้อมเชิงการยอมรับแม้ว่าจะปรากฏให้เห็นได้อยู่ของการมีอยู่ในขั้นตอนการทำสวนป่าในพื้นที่เมืองลีง แต่ก็ยังถือว่าเกิดขึ้นน้อยมาก ความยุติธรรมทางสิ่งแวดล้อมเชิงกระจายที่สามารถสะท้อนได้เป็นหลักจากการทำสวนป่าในพื้นที่เมืองลีง คือ การกำหนดสิทธิในที่ดินสำหรับพื้นที่การทำสวนป่า การพิจารณาถึงคุณสมบัติของผู้ที่จะขึ้นทะเบียนสวนป่าอื่นๆ และความยุติธรรมทางสิ่งแวดล้อมเชิงกระบวนการ ที่สะท้อนได้จากขั้นตอนการทำสวนป่าในพื้นที่เมืองลีง ได้แก่ การให้ประชาชนสามารถเข้าถึงข้อมูล การกำหนดและเผยแพร่ขั้นตอนการดำเนินการตามกฎหมายอย่างชัดเจน การเพิ่มการประชาสัมพันธ์เพื่อให้ประชาชนเข้าถึงข้อมูลได้มากยิ่งขึ้นและการให้ประชาชนเข้ามามีส่วนร่วม ส่วนความยุติธรรมทางสิ่งแวดล้อมที่เป็นการยอมรับ นั้นสามารถสะท้อนโดยภาพรวมของการทำสวนป่าในเมืองลีง แต่ยังไม่สามารถสะท้อนได้อย่างเฉพาะเจาะจงถึงการพิจารณาถึงความยุติธรรมทางสิ่งแวดล้อมที่เป็นการยอมรับจากการทำสวนป่าในเมืองลีง ได้อย่างชัดเจน ได้แก่ การมีข้อกฎหมายหรือนโยบายกำหนดถึงการมีส่วนร่วมของประชาชนในการทำสวนป่า การที่ไม่มีกฎหมายกำหนดห้ามใครโดยเฉพาะเจาะจงในการเข้าถึงการทำสวนป่า จึงสามารถตีความได้ว่าการทำสวนป่าในพื้นที่เมืองลีงนั้นสะท้อนความยุติธรรมทางสิ่งแวดล้อมเชิงการยอมรับคือ การไม่เลือกปฏิบัติ การไม่จำกัดสิทธิใครคนใดคนหนึ่งในการเข้าถึงการทำสวนป่า ซึ่งยังเป็นความไม่ชัดเจนหรือยังไม่มากพอของข้อมูลที่จะระบุได้อย่างชัดเจนของการมีอยู่ของความยุติธรรมทางสิ่งแวดล้อมที่เป็นการยอมรับ จากการทำสวนป่าในพื้นที่เมืองลีง จังหวัดสุรินทร์

จากข้อมูลที่ค้นพบถึงการมีอยู่ของความยุติธรรมทางสิ่งแวดล้อมทั้ง 3 ด้าน งานวิจัยนี้ได้นำเสนอข้อเสนอแนะเพื่อเป็นการส่งเสริมให้เกิดความยุติธรรมทางสิ่งแวดล้อม ภายใต้ขั้นตอนการทำสวนป่า ในพื้นที่ ตำบลเมืองลีง อำเภอจอมพระ จังหวัดสุรินทร์ มากยิ่งขึ้น
