The NCPO Government’s Policy on Violation of Human Rights and the Rights on Land and Forest in the Jatrabiab Village, Lup Lao Sub-District, Phu Phan District, Sakon Nakhon Province

Abstract

The Purpose of this Research is The NCPO Government’s Policy on Violation of Human Rights and the Rights on Land and Forest in the Jatrabiab Village, Lup Lao Sub-District, Phu Phan District, Sakon Nakhon Province. the Case Study of Disputes on Land and Forest Rights were to Study and Research the Announcement and Order of the National Council for Peace and Order in 2014-2018 that Violates the Universal Declaration of Human Rights, and to Study and Research the Perspectives of People who have Violated Human Rights in the Dimension of Land and Forest Rights of People in the Jatrabiab Village, Lup Lao Sub-District, Phu Phan District, Sakon Nakhon Province. The Data was Collected by Using the In-depth Interview Methods and Documentary Research.

The Result of the Study Showed that in the Term of the Announcement and Order of the National Council for Peace and Order in 2014-2017, it was Found that there are Many Announcements both Civil Rights Political Rights Economic Rights Social Rights Cultural Rights and Orders that Violate the Universal Declaration of Human Rights and the Policy to Restore the Forests of the NCPO. It affects the Villagers in the Jatrabiab Village, Lup Lao Sub-District, Phu Phan District, Sakon Nakhon Province, the Case Study of Disputes on Land and Forest Rights in Terms of Income and Property, Mental State, and Social Power and Equality.

งานศึกษาวิจัย เรื่อง นโยบายรัฐบาล คสช. กับการละเมิดหลักสิทธิมนุษยชน และสิทธิที่ดินและป่าไม้ของประชาชน บ้านจัดระเบียบ ตำบลหลุบเลา อำเภอภูพาน จังหวัดสกลนคร การวิจัยครั้งนี้ มีวัตถุประสงค์เพื่อศึกษาวิเคราะห์ประกาศ คำสั่ง และคำสั่งหัวหน้าคณะรักษาความสงบแห่งชาติ ในช่วงปี พ.ศ. 2557-2561 ที่ละเมิดหลักปฏิญญาสากลว่าด้วยสิทธิมนุษยชน และเพื่อศึกษาวิเคราะห์ผลกระทบจากนโยบายทวงคืนผืนป่า ในมิติของสิทธิทางด้านที่ดินและป่าไม้ ต่อประชาชนในพื้นที่บ้านจัดระเบียบ ตำบลหลุบเลา อำเภอภูพาน จังหวัดสกลนคร โดยใช้วิธีการสัมภาษณ์แบบเชิงลึกและการวิจัยเชิงเอกสารในการเก็บรวบรวมข้อมูล

ผลการวิจัยพบว่า ประกาศ คำสั่ง และคำสั่งหัวหน้าคณะรักษาความสงบแห่งชาติ ในช่วงปี พ.ศ. 2557-2561 มีประกาศ คำสั่ง และคำสั่งหัวหน้าคณะรักษาความสงบแห่งชาติ ที่ละเมิดหลักปฏิญญาสากลว่าด้วยสิทธิมนุษยชนหลายฉบับ ทั้งด้านสิทธิพลเมือง สิทธิทางการเมือง สิทธิทางเศรษฐกิจ สิทธิทางสังคม และสิทธิทางวัฒนธรรม และนโยบายทวงคืนผืนป่าของรัฐบาล คสช. ส่งผลกระทบต่อชาวบ้านบ้านจัดระเบียบ ตำบลหลุบเลา อำเภอภูพาน จังหวัดสกลนคร ทั้งด้านเศรษฐกิจ ด้านสภาพทางจิตใจ ด้านอำนาจทางสังคม และความเสมอภาค
